MIM: As MIM predicted and was should come as no surprise the Dutch authorities have arrested a 34 year old Moroccan translator who worked for the General Intelligence and Security Service (AIVD), for leaking secrets to Muslim militants. The AIVD employee had also formed a lobby organisation to counter negative portrayals of Muslims in the Dutch media . The Muslim Media Group was similiar to the Arab American Anti Discrimination Committee and CAIR - The Council on American Islamic Relations, which presents itself as a civil rights group which solicits case of 'anti Muslim' bias and files lawsuits against the media and individuals as a form of intimidation.

ROTTERDAM, Netherlands, Jan. 11 (UPI) -- The trial of an Arab who works for the Netherlands' secret service has heard security leaks helped in the assassination of filmmaker Theo Van Gogh.

Outman Ben Amar, an employee of the Dutch secret intelligence agency known as AIVD, is accused of passing a copy of a monitored conversation to a group associated with a Dutch Moroccan who is the chief suspect in Van Gogh's slaying.

The 34-year-old Moroccan-born translator was arrested Sept. 30 and charged with disclosing secrets to third parties, The Independent reported Tuesday.

Prosecutor Annemieke Zwaneveld said Ben Amar was also suspected of passing a list of AIVD investigations to a group in the city of Utrecht whose members were arrested on suspicion of possessing explosives.

Van Gogh, a descendant of the 19th century painter, was shot and stabbed in Amsterdam in November. He was apparently marked for death for a film in which he criticized the treatment of women in Muslim society.

NIJMEGEN - De AIVD'er Othman Ben A. die staatsgeheimen zou hebben gelekt naar de terroristencel rond Van Gogh-moordenaar Mohammed B., is de oprichter van een 'lobbypersclub' van vooruitstrevende moslims.

Deze Moslim Media Groep, waarvan imam Abdullah Haselhoef adviseur was, moest de islamitische tegenhanger van de Israëlische belangenvereniging CIDI worden. De 'professionele mediaorganisatie', zoals ze zichzelf omschreef, kreeg twee jaar geleden landelijke bekendheid toen Haselhoef de groep jonge moslims opriep een demonstratie voor vrede in Israël in Amsterdam niet met geweld en leuzen te verstoren, zoals een week daarvoor wel was gebeurd.

Op 30 september van dit jaar werd de 34-jarige in Marokko geboren tolk/vertaler aangehouden. Hij zou een groep van terrorisme verdachte Marokkanen in Utrecht hebben getipt over een onderzoek van de inlichtingendienst AIVD.

De verdachten uit de Bucheliusstraat in Utrecht zouden in bezit zijn geweest van explosieven, maar die zijn nooit gevonden. Een van de verdachten zou een familielid zijn van Ben A.

Het Openbaar Ministerie vermoedt dat Othman Ben A., die nog steeds in voorarrest zit, ook informatie heeft gelekt aan de Hofstadgroep, een cel van radicale moslims waarvan ook Mohammed B. lid was.

De vermoedelijke moordenaar van Theo van Gogh zou deze informatie via een vriend hebben gekregen. Het is onduidelijk hoe groot de schade is voor lopende onderzoeken van het lekken van de zeer vertrouwelijke AIVD-informatie.

Othman Ben A. vond dat na de aanslagen op de Twin Towers in New York in september 2001 de berichtgeving over moslims in de media 'onvolledig en tendentieus' was.

Hij zocht daarom steun bij Turken, Marokkanen en Nederlanders met een 'islamitische vooruitstrevende achtergrond' om zich hiertegen te verweren.

Volgens Sjoerd Moenander, voormalig MMG-secretaris, is de groep nog voor de officiële registratie bij de Kamer van Koophandel uit elkaar gevallen na een 'meningsverschil over de werkwijze'.

'Sommigen meenden dat we rechtszaken tegen de media moesten voeren om ons punt duidelijk te maken. Anderen vonden dat dat veel te ver zou gaan', aldus Moenander.

Othman Ben A., die volgens betrokkenen bij MMG geen enkele affiniteit had met moslimextremisme, was al eerder uit de MMG gestapt.

Hij liet weten geen tijd meer te hebben omdat hij inmiddels reisagent en directeur van 'de afdeling georganiseerde reizen' was geworden van Chafarinastours. Voor dit in Marokko gevestigde reisbureau werkte Othman Ben A. vanuit zijn huis in Nijmegen.

Voordat hij bij de AIVD werkte, was Ben A. vier jaar lang in dienst bij de IND in Arnhem als 'beslismedewerker'.

Mole in AIVD sent signs and messages via his website

Amsterdam- The AIVD mole who was accused of passing on state secrets to terror suspsects, was using the cover of a website which transmitted hidden messages.

Othman Ben A.(34) ran the site charafinatours.com from his home address on De Wellenkamp in Nijmegen which had the same name as the travel agency which was located in Morocco. An investigation by this paper revealed that some of the photographs contained secret messages.

It has long been known that terrorists have been using website to transfer messages which are invisible. The technique which is used for this is called Stegonography . User of this technique can place messages into pictures and even send complete blueprints of a potential target.

A program especially developed by the FBI had the alarm triggered when it was used to investigate the website of Ben A. Two of the pictures were labelled as 'very suspicious' by the software . This is very unusual since the program is usually never activated when it is used on randomly selected websites. Ben A. is the agent for Cherafinas Tours in Holland. The travel agency was never a money maker since the website appears to only have had a few hundred visitors in the past year .In addition the site was hosted.

Outman Ben A. (34) runde op zijn huisadres aan De Wellenkamp in Nijmegen de site chafarinastours.com, van het gelijknamige in Marokko gevestigde reisbureau. Uit onderzoek van deze krant blijkt dat sommige foto's op de website geheime mededelingen bevatten.

Het is al langer bekend dat terroristen via websites informatie uitwisselen zonder dat deze voor derden zichtbaar is. De techniek die hiervoor wordt gebruikt, wordt steganografie genoemd. Middels deze techniek kunnen in plaatjes berichten worden versleuteld dan wel complete plattegronden van een mogelijk doelwit worden meegezonden.

Een speciaal hiervoor ontwikkeld programma, dat onder meer wordt gebruikt door de Amerikaanse FBI, slaat alarm wanneer de website van Ben A. aan een nader onderzoek wordt onderworpen. Zeker twee afbeeldingen worden door de detectiesoftware als "zeer verdacht" bestempeld. Dit is zeer ongebruikelijk, daar het programma normaal gesproken vrijwel nooit aanslaat bij het opslaan van een willekeurige website. Ben A. is de agent voor Chafarinas Tours in Nederland. Erg winstgevend kan de reisorganisatie niet zijn, aangezien de website slechts enkele honderden bezoekers op jaarbasis trekt. De site blijkt bovendien hier te worden gehost.

Slechte Controle bij AIVD vertalers

ROTTERDAM, 8 JAN. De Algemene Inlichtingen- en Veiligheidsdienst (AIVD) heeft onvoldoende zicht op wat zijn tolken doen met het te vertalen materiaal. De tolken mogen zelf beslissen welke afgeluisterde gesprekken moeten worden bewaard, en welke kunnen worden weggegooid. Dat meldt de Volkskrant vandaag.

De krant beschikt over verklaringen van de 34-jarige AIVD-medewerker en tolk/vertaler Outman Ben A. die wordt verdacht van het lekken van staatsgeheimen aan radicale moslims.

Ben A., een Nijmegenaar van Marokkaanse komaf, werd 30 september 2004 gearresteerd op verdenking van schending van staatsgeheimen en het lekken van informatie aan van terrorisme verdachte personen. Maandag moet hij voor een pro forma zitting van de rechtbank van Rotterdam verschijnen. Outman Ben A. was naar alle waarschijnlijkheid betrokken bij het onderzoek naar het zogeheten Hofstadnetwerk. Hij zou uiterst geheime stukken naar leden van dit netwerk in Amsterdam en Den Haag hebben gelekt.

Uit de stukken waarover de Volkskrant beschikt, blijkt dat Ben A. zonder richtlijnen zijn werk deed en zelf mocht bepalen of een gesprek belangrijk was of niet. Zo groot was het tekort aan tolken bij de AIVD, dat hij al snel na zijn aantreden in oktober 2003 een belangrijke rol kreeg toebedeeld. De reisagent en voormalig medewerker van de Immigratie- en Naturalisatiedienst (IND) kwam van de ene op de andere dag terecht in een omvangrijk terrorisme onderzoek, ,,zonder dat hij werd ingewerkt".

Op zaterdag 25 september 2004 kwam informatie bij de AIVD binnen dat een persoon uit een islamitisch terroristisch netwerk zou beschikken over AIVD-informatie. De dag erna viel de politie binnen bij Hassan O. in Utrecht. Bij O. werden twee A4-tjes gevonden met geheime AIVD-informatie.

Op een van de brieven die werden gevonden stond 'Mouchabarad' geschreven, Arabisch voor geheime dienst. Na de arrestatie van Ben A. noemde de AIVD de schade voor lopend onderzoek gering. Uit het dossier blijkt dat justitie vermoedt dat er veel meer informatie is gelekt.

Proces AIVD - medewerker wordt openbaar behandeld

ROTTERDAM (ANP) - De rechtbank in Rotterdam behandelt de strafzaak tegen een 34-jarige oud-medewerker van de Algemene Inlichtingen en Veiligheidsdienst (AIVD) Outmar Ben A. niet achter gesloten deuren, maar openbaar. Dat heeft de rechtbank maandag besloten.

Justitie beschuldigt Ben A. ervan dat hij staatsgeheimen heeft gelekt. Het is voor het eerst dat een werknemer van de dienst is opgepakt voor het lekken van staatsgeheimen en daarvoor moet terechtstaan. De rechtbank behandelt de zaak tegen Ben A. nog niet inhoudelijk, omdat justitie het onderzoek nog niet heeft afgerond.

Officier van justitie A. Zwaneveld verwacht dat de rechters de zaak begin april inhoudelijk kunnen behandelen. Een verzoek om de voorlopige hechtenis van de verdachte op te heffen, wees de rechtbank maandag af.

Arrestaties

De Rijksrecherche hield Ben A. 1 oktober aan op het kantoor van de AIVD in Leidschendam. Hij werkte volgens de dienst pas korte tijd bij de AIVD en de dienst schorste hem onmiddellijk na de ontdekking van het lekken. Ook liet de AIVD weten dat de schade aan de lopende onderzoeken gering was.

Naast Ben A. hield de politie ook drie anderen aan. Zij hadden geheime informatie van de tolk van de AIVD ontvangen en justitie houdt hen verantwoordelijk voor heling. Deze verdachten zijn inmiddels weer op vrije voeten, maar moeten wel beschikbaar blijven voor justitie. Ook moesten zij hun paspoort inleveren.

"AIVD ATTACKS FREEDOM OF SPEECH

Last week the AIVD contacted one of the editorial staff of RTL's political talk show: Barend and Van Dorp. They made a complaint about one of the guests in the show: intelligence analyst, and Fringe editor, Roger Vleugels. There message was in essence a strong advice to the talk show hosts: invite him never again.

The meaning is clear: as far as intelligence and security matters are concerned, the AIVD puts pressure on the media, in order to influence which intelligence watcher should be given access to the media.

This is not the first time the AIVD has tried to prevent Vleugels from appearing on national media, so it has all the hallmarks of regular policy. Similar remarks were made on behalf of the minister of internal affairs to the editorial staff of NPS's tv program Buitenhof after comments by Vleugels on the September 11 attacks.

A question from Fringe's Complaint Centre: Are there more AIVD attacks on the freedom of speech? Not only concerning analysts, watchers, but also efforts like blocking news items, and so on.

A day after Rogier Vleugels was a guest last week at Barend & van Dorp, the AIVD told the tv program that they preferred not to have Vleugels described as "an expert on the subject of the intelligence services'. Vleugels reported this in his electronic newsletter. He followed the Dutch intelligence services fo 25 years and regularly files lawsuits against the agency to force them into being more accountable.

Today the chief editor of B&vD Eric de Vries wrote in a GPD article: My answer was : Let the boss of the AIVD, Sybrand van Hulst, come to explain that here. Third separate secret service

Sigint stands for Signals Intelligence, also called as the connection intelligence service.Interception of this information such as the tapping of phones, and also radio, fax, and internet traffic is considered to be of utmost importance.in the fight against international terrorism.

At present the non cable connected telecommunications traffic is intercepted by two large antennas which are based at the satellite ground station in Zoutkamp in Groningen. But the capacity, according to intelligence expert, is not enough and the satellite interception capacity has to greatly expanded. First six dish antennas will be placed, but finally according to the Defense ministry, 22 dishes must be set up.

Minister Remkes wants to change the present Law for the Intelligence and Security Services in order to permit the NSO to decide for themselves which news traffic to intercept. To this end he will present a new proposal for a law to the ministry.

There are many other countries which have their own independent agency for the interception of satellite communications. In the US it is the National Security Agency(NSA) and in Great Britain it is the government communication headquarters.(GCHQ).

Derde Geheime Dienst Apart

Naast de AIVD en de MIVD krijgt Nederland er binnenkort een derde zelfstandige inlichtingendienst bij. De Nationale Sigint Organisatie (NSO), die nu nog ressorteert onder de militaire inlichtingen- en veiligheidsdienst (MIVD), houdt zich bezig met het onderscheppen van berichtenverkeer van communicatiesatellieten.

In een brief van minister Remkes (Binnenlandse Zaken) aan de Tweede Kamer staat dat de NSO als ,,derde dienst" zal worden verzelfstandigd en opgenomen in de Wet op de Inlichtingen- en Veiligheidsdiensten. Tot nu toe werkt de dienst alleen ondersteunend voor zowel de MIVD als de Algemene Inlichtingen- en Veiligheidsdienst (AIVD). Tot de oprichting van die dienst besloot het kabinet kort na de aanslagen op 11 september 2001 in de Verenigde Staten.

Sigint staat voor Signals Intelligence, ook wel verbindingsinlichtingen genoemd. Onderschepping van deze inlichtingen zoals het aftappen van telefoongesprekken, maar ook radio-, fax- en internetverkeer wordt als uitermate belangrijke beschouwd in de strijd tegen het internationale terrorisme.

Nu wordt het niet-kabelgebonden telecommunicatieverkeer onderschept met twee grote antennes die staan opgesteld op het satellietgrondstation in het Groningse Zoutkamp. Maar de capaciteit is volgens inlichtingenexperts niet genoeg en moet de satellietinterceptiecapaciteit fors worden uitgebreid. Eerst komen er zes schotelantennes bij, maar uiteindelijk zouden er volgens Defensie 22 reuzeschotels moeten komen.

Minister Remkes wil nu de Wet op de Inlichtingen- en Veiligheidsdiensten wijzigen om aan de NSO een eigen bevoegdheid tot het onderscheppen van het berichtenverkeer toe te kennen. Daartoe zal hij aan het eind van het jaar een wetsvoorstel aanbieden aan de ministerraad. Overigens beschikken veel andere landen al over een eigen zelfstandige dienst voor de onderschepping van satellietcommunicatie. The fractions of D'66,LPF and Groen Links have tabled a motion to demand that the government ' reconsider' article 147 from the Penal Code - which regulates the laws of blasphemy . The motion can likely reckon on support of the VVD and SP , the PvdA is still unsure.Minister Donner (justice CDA) advised against the motion and called upon the house not to scrap the law.

Last Thursday Donner announced that he would like to investigate the possibility of stronger punishments against blasphemy and religious insults .During the weekly question hour in the house yesterday ,House member Van der Laan (D'66) asked Donner why he had placed scornful blasphemy on the agenda. The house is considered about possible limits to free speach and finds that Donner's priorities are wrong. The fight against Muslim terrorism must now be a priority the House found.

According to Van der Laan there are enough possibilities , without article 147 to protect against insults. VVD, SP,Groene Links, en LPF supported D'66. The PvdA is also prepared to scrap the law if it turns out not to have a majority according to PvdA leader Bos ." In principle we are on the side of D'66 and VVD",Bos said this morning. House member Wolfsen (PvdA) let it be known that PvdA will vote against scrapping law 147 if the result is that blasphemy will be more strongly punished then is now the case." At present their is a punishment of 3 years in jail for blasphemy, and a maximum sentence of one year for other forms of insult.

Donner stated that this year the House had requested the removal of the so called incitement statutes in the penal code. This occured after a debate about the radical Muslim Al Tawheed mosque. The investigation is still onderway and last week the articles regarding blasphemy and insult were added, according to Donner.

House member Van der Staaij (SGP) said that as far as he was concerned the motion "breathed the spirit of anti religous fanaticism" and he spoke of "utter foolishness". Van der Laan said that it was not her intention to organise and "anti Christian party" in the House but it was about equal treatment under the law for all points of view.

De fracties van D66, LPF en GroenLinks hebben vanmorgen een motie ingediend die de regering opdraagt artikel 147 uit het Wetboek van Strafrecht - waarin de strafbaarstelling van godslastering wordt geregeld - te ,,heroverwegen". De motie kan waarschijnlijk op steun rekenen van de VVD en de SP, de PvdA twijfelt nog. Minister Donner (Justitie, CDA) ontraadt de motie en roept de Kamer op het wetsartikel niet te schrappen.

Afgelopen zaterdag had Donner aangekondigd dat hij wil onderzoeken of godslastering en belediging strenger kunnen worden bestraft. Gisteren, tijdens het wekelijkse vragenuurtje in de Kamer, wilde Kamerlid Van der Laan (D66) van Donner weten waarom hij smalende godslastering op de agenda heeft gezet. De Kamer maakt zich zorgen over een mogelijke inperking van de vrije meningsuiting en vindt dat Donner zijn prioriteiten verkeerd legt. De bestrijding van moslimterrorisme moet nu vooropstaan, vindt de Kamer.

Volgens Van der Laan zijn er, los van artikel 147, genoeg mogelijkheden om iedereen, ook gelovigen, te beschermen tegen belediging. VVD, SP, GroenLinks en LPF steunden D66. Ook de PvdA is bereid het wetsartikel te schrappen, als blijkt dat het geen meerwaarde heeft, aldus PvdA-leider Bos. ,,Principieel staan we aan de kant van D66 en VVD", zei Bos vanmorgen. Kamerlid Wolfsen (PvdA) zei dat de PvdA tegen zal stemmen ,,als het gevolg van het intrekken van 147 is dat godslastering strenger wordt bestraft dan nu het geval is". Op godslastering staat nu maximaal drie maanden gevangenisstraf, op andere vormen van belediging maximaal een jaar.

Donner verklaarde dat de Kamer in april dit jaar om een onderzoek heeft gevraagd naar verruiming van zogenoemde haatzaai-artikelen in het strafrecht. Dit gebeurde naar aanleiding van een debat over de radicale Amsterdamse Al Tawheed-moskee. Dit onderzoek loopt nog en daaraan zijn vorige week de artikelen over belediging en godslastering toegevoegd, aldus Donner.

Kamerlid Van der Staaij (SGP) zei vanmorgen dat de motie wat hem betreft ,,een geest van antigodsdienstig fanatisme ademt" en hij sprak van ,,een zotternij". Van der Laan zei dat het niet haar bedoeling was ,,een antichristelijk feest" te organiseren in de Kamer, maar dat het haar om gelijke behandeling van alle meningen gaat.

Minister Donner proposes stronger measures against blasphemy. But he acheived the opposite result. The house wants to scrap the legal statutes against blasphemy.

There was an atmosphere of bewilderment by the Christian Democratic Party in the Lower House yesterday. "A bizarre meeting" said fraction chairman Verhagen of the Christian Democrats.

Christian Union chairman Rouvoet: "Two years ago when Pim Fortuyn remarked that freedom of speach was the highest priority and should supercede even the laws against discrimination, Holland was too small. Now we hear that that in any case the law against scornful blasphemy must give way to freedom of speach.That seems to me disproportionate".

SPG'er Van der Vlies;"If we scrap this determination ourselves wont this give a signal that people can do this with relative impunity "?

Minister Donner (Justice) has last week at the CDA congress during the weekend that he would like to determine if article 147, which involves the regulation of scornful blasphemy can be made even stricter. The Christian party also concurred.

But then it happened. Minister Verdonk (Foreign/immigration policy VVD)reacted Sunday on tv with reservations about the suggestion of Minister Donner.Minister De Graaf (Governmental renewal VVD) entered into the debate Monday to point out that the cabinet policy is that there a no new laws needed to guarantee freedom of religion.

And yesterday, during the weekly question and answer session in the House, three quarters of the House members were found to be strongly in favor of scrapping the statutes which make blasphemy punishable by law.

Under the leadship of House member Louisewies van der Laan (D'66) the non confessionals opened fire. "Why should an insult against someone with a different skin color, a woman, or a handicapt person,be punished differently then insulting of a Christian or Muslim? To we want to live in a society where religious people have more rights then atheists of agnostics ? D'66 doesnt want that. We find that it is time to do away with the blasphemy statute." said van der Laan.

Afterwards Groenlinks, the VVD,the LPF and the SP and the PvdA, also joined with them. Halsema (Groenlinks);"My party doesnt not want religious people to have special position when it pertains to blasphemy or or insulting religion.: VVD chairman Van Aartsen: "Why isnt the minister giving precedence to the real priorities?" "We are clear".LPF'er Erdmans;"Is Mrs. Van der Laan prepared together with the majority of this House to take leave of this article and thereby to support a motion to change the constitution?" SP leader Marijnessen; "My party will support every initiative to remove the statute". PvdA leader Bos : It there comes talk of a concrete proposal to remove this article which is now law, and has no added value in relation to these norms, we will support it".

With the house majority in favor of removing article 147 Donner's remarks came back as a boomerang. Donner tried to make it clear to the house that he did not intend to curtail freedom of speach that it's not even the beginning of stricter rules.In between the house moderator asked that the proposed motion be postponed until the completion of further investigation."A discussion of this rules now would send the wrong signal". according to Donner and Verdonk.

The motion would give the cabinet the room to further investigate (the law's) possible removal as was explained in last weeks letter. If on the basis of (the investigation) it turns out that there are no practical reasons against the removal of article 147, then the statute should be expunged.

The only problem which remains is the principle disagreement between liberal and Christian democrats.Just like the House the cabinet is also divided. This came to light during the discussion about freedom of religion and how to deal with radical mosques.

Godslastering als boemerang voor Donner

Minister Donner stelde voor godslastering strenger aan te pakken. Maar hij bereikt het tegendeel. De Kamer wil nu af van het apart strafbaar stellen van godslastering.

DEN HAAG, 17 NOV. Verbijstering heerste gisteren bij de christelijke partijen in de Tweede Kamer. ,,Een bizarre bijkomstigheid", zei fractievoorzitter Verhagen van het CDA.

ChristenUnie-voorman Rouvoet: ,,Toen Pim Fortuyn tweeënhalf jaar geleden geleden opmerkte dat de vrijheid van meningsuiting boven alles ging en dat daarvoor zelfs het verbod op discriminatie zou moeten wijken, was Nederland te klein. Nu horen wij dat in ieder geval het verbod op smadelijke godslastering moet wijken ten gunste van de vrijheid van meningsuiting. Dat lijkt mij niet in verhouding."

SGP'er Van der Vlies: ,,Als wij nu zelf die bepaling schrappen, levert dat dan niet het signaal op dat het allemaal wel wat gemakkelijker kan?"

Minister Donner (Justitie, CDA) had afgelopen weekend op het CDA-congres desgevraagd gezegd dat hij wil onderzoeken of artikel 147, waarin de bestraffing van smalende godslastering wordt geregeld, strenger toegepast kan worden. Daar konden de christelijke partijen zich in vinden.

Maar toen gebeurde het. Minister Verdonk (Vreemdelingenbeleid, VVD) reageerde zondag op tv terughoudend op die suggestie van Donner. En minister De Graaf (Bestuurlijke Vernieuwing, D66) mengde zich maandag in het debat door te stellen dat het kabinetsbeleid is dat er geen extra maatregelen nodig zijn om de vrijheid van godsdienst te garanderen.

En gisteren, tijdens het wekelijkse vragenuurtje in de Tweede Kamer, werd binnen drie kwartier een Kamermeerderheid gevonden die zich ferm uitsprak voor afschaffing van het artikel dat godslastering strafbaar stelt.

Onder aanvoering van Kamerlid Lousewies van der Laan (D66) openden de non-confessionelen het vuur. ,,Waarom moet het beledigen van iemand met een andere huidskleur, een vrouw of een gehandicapte anders bestraft worden dan het beledigen van een christen of een moslim? Willen wij een samenleving waarin gelovigen meer rechten hebben dan atheïsten of agnosten? D66 wil dat niet. Wij vinden het dan ook tijd om het artikel over godslastering te schrappen", zei Van der Laan.

Vervolgens sloten GroenLinks, de VVD, de LPF, de SP en de PvdA zich daar bij aan. Halsema (GroenLinks): ,,Mijn fractie wil geen bijzondere positie voor gelovigen als het gaat om beledigen of godslastering." VVD-fractievoorzitter Van Aartsen: ,,Waarom geeft de minister geen voorrang aan de echte prioriteiten? Wij zijn helder." LPF'er Eerdmans: ,,Is mevrouw Van der Laan bereid om samen met een grote meerderheid van deze Kamer afscheid te nemen van dit artikel en een grondwetswijziging daartoe te steunen?" SP-leider Marijnissen: ,,Mijn fractie zal elk initiatief om het wetsartikel te schrappen, steunen." PvdA-leider Bos: ,,Als er straks sprake zou zijn van een concreet voorstel om een artikel dat nu in de wet staat, dat [..] dat helemaal geen toegevoegde waarde blijkt te hebben ten opzichte van deze normen, uit de wet te halen, zullen wij dat steunen."

Met de Kamermeerderheid voor het schrappen van artikel 147 kwam de opmerking van Donner als een boemerang terug. Donner probeerde de Kamer duidelijk te maken dat het hem niet ging over een inperking van de vrijheid van meningsuiting, dat er ,,nog geen begin van een aanscherping" is. Hij wilde slechts ,,een onderzoek doen naar de vraag of het instrumentarium moet worden aangescherpt". Daarmee herhaalde hij wat hij een week eerder, in een brief naar aanleiding van de moord op Theo van Gogh, met zijn collega Remkes (Binnenlandse Zaken, VVD) had aangekondigd. Het mocht niet baten. De Kamer hield ogenschijnlijk voet bij stuk: 147 zou geschrapt worden, hoewel Donner gezegd had dat dat niet via een motie geregeld kan worden.

Vanmorgen, bij de begrotingsbehandeling van Justitie, diende Van der Laan inderdaad een motie in. Daarin bepleitte zij echter niet letterlijk het afschaffen van artikel 147, maar verzoekt zij de regering ,,artikel 147 te heroverwegen, rekening houdend met de verhoudingen in de Kamer".

Van der Laan lijkt zich bij de formulering van de motie te hebben laten leiden door een brief van Donner en Verdonk, die vanmorgen vroeg naar de Kamer werd gestuurd. Daarin vragen de bewindslieden de Kamer om de aangekondigde motie vandaag niet in te dienen en te wachten op het onderzoek. ,,Een discussie op dit moment over het intrekken van de betrokken bepalingen [zou] een verkeerd signaal zijn", schrijven Donner en Verdonk.

Die motie laat het kabinet de ruimte door te gaan met het onderzoek naar de mogelijke verruiming, zoals aangekondigd in de brief van vorige week. Als op basis daarvan mocht blijken dat er geen praktische bezwaren kleven aan het schrappen van artikel 147, kan het artikel in principe afgeschaft worden.

Het enige probleem dat dan nog resteert, is de principiële tegenstelling tussen liberalen en christen-democraten. Net als de Kamer is namelijk ook het kabinet verdeeld. Dat kwam al eerder aan het licht bij discussies over de vrijheid van godsdienst en het aanpakken van radicale moskeeën

According to Socialist Party leader Jan Marijnessen:

" In the aftermath of the killing of Theo van Gogh and the incidents of arson alot of people are having a problem of how the constitutional rights of freedom of speach and freedom of religion are related to each other.'The article in question can be removed. But to talk about that now will give the impression that everything is allowed in the realm of public debate".

MIM: It is not surprising that the 'godless socialists' are the first ones to condesendingly say that 'the 'people' do not understand what is going on and need the government to decide what is best for them. Marijnessen also states that people should be aware that free speach is limited and the the Dutch are not yet ready to 'rationally' discuss the question of the blasphemy laws.

The day after Theo Van Gogh's murder, Deputy Minister Gerrit Zalm stated that "Holland is at War". Zalm was attacked by fellow politicians and Marijnessen was quoted as sarcastically saying " Are the cannons going to come out of the forts?" http://www.militantislammonitor.org/article/id/313
