May 30, 2012 - San Francisco, CA - PipeLineNews.org - On May 21, Kansas Governor Sam Brownback signed into law a piece of legislation entitled American Laws For American Courts [SB79[.
The vote was lopsided and extraordinarily bipartisan, 33-3 in the senate and a unanimous 120-0 in the house of representatives.
The bill was authored by Rep. Peggy Mast and modeled upon a framework - American Laws for American Courts, developed by the American Public Policy Alliance.
The intent of the legislation is simple, yet important, to protect the American system of jurisprudence against the intrusion of foreign/"international," often religious [read Shari'a] legal concepts and doctrines. Though a largely unrecognized phenomenon, these same foreign/religious elements have been incrementally wending their way into American court decisions for many years. A recent study commissioned by the Center for Security Policy has identified at least 50 such cases where exactly that has happened.
This landmark legislation was strongly opposed by the Council on American Islamic Relations [CAIR] a Muslim Brotherhood front group which [despite it having been named as an unindicted co-conspirator in the United States' largest prosecution of domestic funding on the Palestinian terrorist group Hamas - U.S. v. Holy Land Foundation for Relief and Development] still holds great sway within leftwing circles, especially the activists at the ACLU.
Note: Federal District Court Judge Jorge Solis in a 2009 post prosecution decision arising out of the Holy Land case, was very clear in associating CAIR with Hamas, "The government has produced ample evidence to establish the associations of CAIR, ISNA, NAIT, with NAIT, the Islamic Association for Palestine, and with Hamas," U.S. District Court Judge Jorge Solis said in the July 1, 2009, ruling.." Hamas was created by the Muslim Brotherhood to destroy Israel through Islamic jihad.
Though CAIR claims that the new law discriminates against Muslims, a strict reading of the bill's legal text does not support such a charge. Rather it, in plain language, simply ensures that all Americans of whatever religious persuasion are treated equally and that the U.S. Constitution will remain the supreme law of the United States.
Keeping Shari'a principles from having any impact on the U.S. legal system is a serious matter, as Shari'a is entirely incompatible with Western forms of democratic governance.
