Unbelievable - Holder Justice Department Sues To Enforce "Right" To Wear Hijab By Corrections Officers

June 8, 2009 - San Francisco, CA - PipeLineNews.org - Obama's highly politicized Justice Department has brought suit against Essex Country, NJ alleging that it discriminated against a Muslim corrections officer on the basis of her religion because she was denied permission to wear a Muslim religious head covering.

DOJ alleges that Essex County is in violation of Title VII of the Civil Rights Act of 1964.

According to the complaint, the Essex County Department of Corrections (DOC), first suspended Beshier and then terminated her on the ground that her wearing of a khimar (a head scarf) violated its uniform policy for corrections officers. The complaint alleges that Beshier had requested a religious accommodation that would permit her to wear her khimar, but the DOC denied her request.

Speaking for DOJ Loretta King Acting Assistant U.S. Attorney General, Civil Rights Division, stated, "Employees should not have to choose between their religious beliefs and their economic livelihood," said Loretta King, Acting Assistant Attorney General for the Civil Rights Division. "Federal law requires all employers, even those having policies regarding the wearing of uniforms, to reasonably accommodate the religious observances and practices of their employees."

The filing of this lawsuit is another sign that the Obama administration is taking a fast-track advocacy role in promoting Shari'a, doing the bidding of the stealth jihad in a manner that sets a onerous and harmful precedent

Of note, in an April unanimous decision, Philadelphia's 3rd Circuit Court ruled against an identical lawsuit involving the case of Kimberlie Webb who claimed that her civil rights were violated when she was not allowed to wear an Islamic head covering while on duty as a police officer in the city of Philadelphia. In the opinion, Judge Anthony J. Scirica held that allowing Ms. Webb to wear religious garb would violate the "religious neutrality" under which the police department operates and impair its effectiveness, "the essential values of impartiality, religious neutrality, uniformity, and the subordination of personal preference would be severely damaged to the detriment of the proper functioning of the police department."

"There are those who will continue to want to divide by fear - to pit our national security against our civil liberties - but that is a false choice. We have a solemn responsibility to protect our people while we also protect our principles."
