Why Did President Obama Free Terrorist Musa Ali Daqduq?

May 29, 2012 - San Francisco, CA - PipeLineNews.org - Earlier this month, May 12 to be specific, an Iraqi court freed a known terrorist and Hezbollah commander, Ali Musa Daqduq from incarceration, declaring the evidence against him to be of insufficient stature to keep him behind bars.

Thus he became a free man, eager to return to the Islamic jihad.

Daqduq is not an Iraqi, but rather was born in Lebanon and was a citizen of that country at the time of his capture by American forces, whereupon he was placed in American custody.

The incident which led to Daqduq's apprehension took place in the Iraqi city of Karbala, the scene of some of the most brutal fighting of the war. President Bush's surge had been announced just 10 days previous in a televised national address. At the time Daqduq was leading a terrorist group calling itself Asaib Ahl al-Haq [AAH].

On January 20, 2007 Daqduq and his fellow insurgents wearing American uniforms and carrying forged identification [source, http://www.nytimes.com/2012/05/08/world/middleeast/in-case-that-has-vexed-americans-defendant-in-iraq-could-go-free.html] see] attacked an American position, killing one G.I. outright and capturing four others. Subsequently their bodies were dumped alongside a road, horrifically tortured at the hands of Daqduq and his thugs before being butchered by them.

The dark details of this incident were, to our knowledge never adequately reported by the MSM. There appeared to be no curiosity to scratch below the surface of this story - standard procedure when dealing with this administration.

The case did not have to be resolved in this unjust manner; it never should have been allowed to reach that point. Daqduq was only under Iraqi custody - rather than American - because of the actions taken by the Obama administration. As a result of Mr. Obama's incredibly poor judgment, Daqduq had been transferred from American custody into the hands of the inept and corrupt Iraqi justice system. This was done upon the withdrawal of American forces from the country, which took place in December 2011.

The administration has justified its actions by claiming that it had no choice in the matter because, the U.S. was required to do so under the provisions of the Status of Forces Agreement [SOFA] to deliver Daqduq to the Iraqis.[Full text of document available here, SOFA]

The problem with the administration's version of events is that it's not believable, the Status of Force Agreement only applies to Iraqis, not to foreign nationals.

The Daqduq case could have easily and legally been handled in a manner which would have resulted in him facing these serious charges under American jurisdiction. As a result he would have received the punishment which was his due and perhaps in a more important sense, this might also have provided an opportunity for some measure of closure for the families of these five brave warriors who gave their all. Clearly, Daqduq deserves to be sitting in GITMO, or another military detention center where he could be tried by a military commission.

Mr. Obama - likely taking into account the poor reception such an action would have had on his hard left financial backers and with an eye towards November - chose rather to set in motion a process which he certainly must have known in advance would eventually result in the release of Daqduq upon the American exit from Iraq.

Justifiably outraged by the handling of this matter, U.S. Representative Lt. Col [ret] Allen West recently drafted a letter to the President, demanding an explanation for his administration's outrageous behavior in this case. The letter can be viewed here Rep. Previous to holding public office, Lt. Col. [ret] West served with great honor and devotion for 22 years in the U.S. military, including a combat deployment in Iraq and knows what he is talking about.

In the letter sent on May 16, Mr. West stated, "Your Administration, instead of standing up for the Soldiers who perished at the hands of this terrorist, handed a senior Hezbollah operative responsible for the gruesome murder of at least five Americans to a "so-called" justice system that, with the facts so clearly showing him guilty, set him free."

Additionally West demanded, "Mr. President, due to the importance of this issue, the American people await your prompt and personal response to this letter. As the Commander-in-Chief, you owe them nothing less."

As of this writing there has been no response from the White House. We along with the rest of America await a full and complete explanation from Mr. Obama, though given his history and its current lockdown mode, we have little hope that this will ever happen.
