MIM: Although the Senate committee announced the closing of the IRS investigation it is ongoing, and Kind Hearts was the organisation specifically slated as warranting ongoing and extensive law enforcement scrutiny.

Kind Hearts for Terror

'Charity' under law enforcement scrutiny schedules new fundraising tour in U.S. with Al Qaeda linked Jamaat Tableeghi missionary/ recruiters from abroad.

The gloating by radical Islamist organizations in the United States that a Senate Committee investigation into 26 Islamic charities is has exonerated them appears to be premature. According to an article in an Ohio paper: ".The Senate Finance Committee is done reviewing Internal Revenue Service records it requested two years ago, but that "does not mean that these groups have been cleared by the committee," chairman Charles Grassley, R-Iowa, said in a statement Tuesday.

" Grassley said the committee will continue to examine the charities' operations, reversing a statement he made two weeks ago that the committee "did not find anything alarming enough that required additional follow-up beyond what law enforcement is already doing..."http://www.ohio.com/mld/beaconjournal/news/state/13343547.htm

According to Senator Charles Grassley (R-Iowa), the scrutiny is ongoing and one article singled out the Kind Hearts 'charity' base in Toledo Ohio as a group which is of special interest to law enforcement. The same article also mentioned another salient fact: That it was none other then Jihad Smaili, a lawyer from Cleveland who testified in front of the Senate Committee hearing. "KindHearts' lawyer, Jihad Smaili of Cleveland, said testimony before the Senate Banking Committee this summer amounted to unfair "guilt by association," he told The Plain Dealer. ".Smaili acknowledges that some of the testimony before the Senate Banking Committee raised mistakes KindHearts had made. An employee of a charity closed by the government worked for KindHearts until he was charged with conspiracy, aiding a terrorist group and money laundering.." What the article failed to mention is that Jihad Smaili is the brother of Khalid Smaili who is the director of Kind Hearts.

When journalists tried to reach Khalid Smaili for comment they were told he was in Lebanon. Which begs the question as to if he plans to come back, since Kind Hearts is simply a continuation of the Global Relief Foundation, which was closed down by the Department of Treasury for ties to Al Qaeda. A look at the Kind Hearts website shows why law enforcement might take more then a passing interest in the Toledo Ohio based charity with the warm fuzzy name.

A banner headline on the KH website (since removed) recently announced that Zulifiqar Ali Shah,( the former president of the Islamic Circle of North America / Muslim American Society, (linked to Al Qaeda) and CEO of the Universal Heritage Foundation, is coordinator for the Kind Hearts South Asia Division.

Shah ran a School for Islamic Studies in Broward, which launched the terrorist career of Jose Padilla - the dirty bomber wannabe set to go on trial together with Adhan Hassoun ( the man who raised the money to send him to Jihad training camp) It is believed that Jose Padilla and Adnan Hassoun met each other as the SISB mosque.

The co founder of the school, Mohammed Javed Qureshi, who, besides his role as co founder of a Saudi backed Islamic school, also supervised the Taco Bell where Padilla (and his wife) were employed. Last year Qureshi admitted that it was him and his wife who helped the Padillas convert to Islam. Hassoun ran the office of the Benevolence International Foundation ( an Al Qaeda funding front started by the jailed Arnaam Arnout, who married a Florida woman. The BIF offices which were convienently located across the road from Qureshi's Taco Bell.

Shah was recently in Pakistan and the Kind Hearts website informs us that : " As announced by Dr. Zulfiqar Ali Shah, KindHearts fully support Pakistan Prime Minister and Pakistani Governments Relief initiatives, Junaid Jumshaid Foundation, Sahara Foundation, Al-Khidmat and other NGOs who are efficient and completely transparent for the accountability of their financial transactions, their Relief Work and Development projects to alleviate suffering of the survivors of this natural disaster."

In an article entitled "Militants make mileage out of earthquake relief " revealed that the 'relief funding', was indeed literally ending up in the hands of terrorists, who were also using orphanages as recruiting grounds for new Jihadis. Not surprisingly a large part of Kind Hearts 'charity' funding goes to 'orphans'. Numerous newspaper accounts revealed that U.S. soldiers called on to help were working side by side with terrorists from the Laskar e- Taybaa and Jammaat and it's Jamaat e Da'wa front. A manifestation of this was seen in a BBC television report, which showed that aid efforts were being hindered after confrontations broke out between Muslim aid workers and clerics who insisted that Muslim quake survivors could not be given food during Ramadan despite the life and death situation. The situation was so volatile that the workers had to promise that they would make sure the aid recipients would not break the Ramadan fast.

"...In the shattered cities and toppled villages of Pakistan's earthquake zone, a new front has opened in the "war on terrorism".

As the world played aid catch-up at the weekend, pledging US$5.8 billion ($7.9 billion) in assistance, and with the Prime Minister, John Howard, due to arrive in Islamabad today, Muslim extremist groups are basking in what Pakistani commentators say is a new-found legitimacy courtesy of their quick response to the disaster.

A stream of reports since the October 8 catastrophe, which killed more than 73,000 people and left more than 3 million homeless, suggest Islamic charities linked to extremists have taken over much of the relief effort across a wide area of northern Kashmir and adjoining areas.."

"...A prominent member of the JUD relief effort is Dr Amir Aziz Khan, arrested on suspicion of al-Qaeda links but later released.

Militants are also reportedly taking orphaned children under their wing for indoctrination in holy war in their extensive network of orphanages...."

"... All of which places the military ruler, Pervez Musharraf, in a tight spot.

His government acknowledges the JUD's good works and denies it is exploiting the disaster.

Yet visiting the region with the United Nations Secretary-General, Kofi Annan, on

Friday, he felt compelled to war the victims to be wary of help from militants.

"If someone shows extremism here, you should rise up against it," he said...

Which begs the second question as to if the United States government was reluctant to go after Kind Hearts because of the support it boasts of having from NGO's and the Pakistani government, abroad, but from the U.S. based, Saudi backed, Arab American Chamber of Commerce, which lists Kind Hearts twice on their website once as a curiously named "appraiser resource" and on the business directory of their website.

Kind Hearts South Asian coordinator Zulfiqar Ali Shah, has returned from Pakistan and is embarking on US fundraising tour for Kind Hearts together with 'two Islamist missionaries' . Saeed Anwar - who is billed as "a famous cricketer" and Junaid Jamshed, listed a a "famous personality".. Cricketeer Saeed Anwar, who was on the same team as Imran Khan (the player turned politician who started the Koran flush rumor which resulted in riots resulting in many deaths) is also connected to a group which is linked to terrorism -Tableeghi Jammat Islami an article informs us that:

"( Anwar )turned to religion and spirituality and took to the Tableeghi Jamaat (missionaries), who practise a stricter adherence to the codes of Islam than most. Anwar's influence spread among senior players such as Saqlain Mushtaq, Mushtaq Ahmed and Inzamam-ul-Haq and the group travel together regularly to Raiwind, a small town near Lahore, where the Tableeghis congregate for prayer and dialogue..". Famous personality Junaid Jamshed was a pop singer in Pakistan who may also be tied to the Tableeghi Jamaat since he : " formally announced . his decision to quit singing to be a full-time preacher.

Explaining his decision, he said, for years he had felt guilty of being a poor role model. Recently, he said, some young people, who had started with religious learning, had told him he had inspired them to seek careers in music.

Mr Jamshed said his family were a religious kind and that he had been the exception. He also said it had taken him nearly five years to arrive at the decision. That finally, he had listened to his heart. His family, he said, supported his decision.." Zufiqar Ali Shah brings ICNA, MAS, and Al Qaeda into the Kind Hearts equation. Both Jamshed and Anwar are members of the Islamic Tableeghi Jamaat which has been described as : 'Recruiting Ground For Al Qaeda Muslim Tablighi Jamaat missionaries proclaim their apolitical views and separation from politics and political causes. Yet Al Qaeda finds the organization's associates a ripe recruiting ground for members.

According to Michael J. Heimbach , the deputy chief of the F.B.I.'s international terrorism section:"We have a significant presence of Tablighi Jamaat in the United States, and we have found that Al Qaeda used them for recruiting, now and in the past...". http://www.parapundit.com/archives/001482.html .

The terrorist affiliations of Shah , Anwar and Jamshed are more then enough reason to close down Kind Hearts and halt their fundraising roadshow in the United States. Adding Khalid and Jihad Smaili to the equation is further proof tha t Kind Hearts (aka Global Relief) is not only fundraising for terrorism - it is being run and supported by potential terrorists and Jihad recruiters in the guise of Tableeghi Jamaat preachers.

Kind Hearts has also announced that the three men will return in 2006 for more fundraising in the United States after their recent effort raised more then 1 million dollars:

By singling out Kind Hearts for continued scrutiny it is clear that the Senate Committee (and the groups lawyer himself ), acknowledge that KH is tied to terrorism. The question is why the government is unable and/ or unwilling to act.and is so reluctant to clarify the status of the investigation and the groups under scrutiny. The travesty of having the brother of the director of Kind Hearts testifying in his capacity as the group's lawyer in front of the Senate Committee and admitting to what he terms "mistakes" such as money laundering and associates jailed for terrorism , shows that it is time to investigate why the government has failed to act. One can only speculate that the organisation claims of 'supporting Musharraf's efforts' and indication that they are sanctioned by the Pakistani government are intended to warn the United States not to interfere with their activities.

Which begs four obvious but urgent questions:

If Kind Hearts is known to be the new face of Global Relief which was closed down by the United States Government because of terrorism funding why hasn't the same thing happened to Kind Hearts?

Why were two 'missionaries' from Tableeghi al Jamaat, an organisation known as a recruiting grounds for Al Qaeda, allowed into the US in the first place?

How can the United States allow Zufiqar Ali Shah, the ex president of the Islamic Circle of North America, and president CEO of the Universal Heritage Foundation, who has been linked to Jose Padilla, Sheik Abdur Rahman Al Sudais and Jerusalem Mufti Ikrima Sabri, to fundraise and control millions of dollars in donations when it was recently revealed that funding for earthquake victims had found it's way to the Kashmiri separatist terrorists aligned with the Taliban and Al Qaeda?

Has Kind Hearts director Khalid Smaili, who declined to be interviewed for an article about the terrorist funding charges directed at his 'charity' ever returned to the United States from his 'holiday' in Lebanon?

The fact that Kind Hearts is still fundraising with impunity after cloning Global Relief, (and brazenly uses the template of the GRF newsletter, which is a designated a terrorist funding entity), is epitomised by this cynical and mocking 'caveat donateur' at the bottom of their donations webpage';

*US Delegation Visited Various Affected Areas: The Delegation included KindHearts' president, Br. Khaled Smaili, and KindHearts' Head of South Asia Division, Dr. Zulfiqar Ali Shah, as well as a group of volunteer doctors from the US. KindHearts' representatives visited the damaged areas in Nelum Valley, Jehlum Valley, Muzaffarabad, Garli Dopatta, Garhi Habibullah, Balakot, Mansehra, Abbodabad, and tent villages in Islamabad.

* 868 Trucks Delivered Emergency Relief Supplies: Along with our partner, Al-Khidmat Foundation, 868 trucks filled with tents, blankets, warm clothing, and food items have been dispatched to Muzaffarabad, Rawalakot, Bagh, Balakot, Mansehra, and Abbodabad.

* 20,000 Earthquake Survivors are Being Fed by KindHearts: During Ramadan, daily Iftar was provided to these families. Additionally, many also received 'Eid Gifts during 'Eid al-Fitr.

* Tent Village in Balakot: KindHearts has established an entire tent village with 103 tents that each house from six to eight family members on the outskirts of Balakot on the banks of Kumhar River. These accommodations are provided free of charge, and include a fully established infrastructure such as water supply, sanitation, and kitchens. In this environment secured by Pakistani police, the inhabitants also receive necessary medical aid.

* Storage of Food and Relief Supplies: Along with our partner Al-Khidmat Foundation, KindHearts has established storage facilities of food and relief supplies in Abbotabad, Mansehra, Bala Kot, and Muzaffarabad.

* 1,000 Orphans to Be Sponsored: Our delegation met with Pakistan's Prime Minister, Shaukat Aziz, who briefed them on the situation and promised to facilitate KindHearts' work—especially our goal to sponsor 1,000 orphans. Our local representative, Br. Ehsan Ilahy, is currently collecting information about children who have lost one or both of their parents, especially those from the remote northern area of Pakistan. The portfolios of these orphans will be available soon.

* Establishing Fiberglass Houses for Homeless Families: Because tents are not suitable shelters in extremely cold weather, KindHearts has teamed up with Sahara for Life Foundation to provide earthquake victims with stable fiberglass houses. KindHearts has already sponsored 100 houses, and we are working to provide more as funds become available.

* Brick Houses for Large Families: Since the fiberglass houses are too small for bigger families, KH has teamed up with Junaid Jumshed, and the former Pakistan Cricket Team Captain, Saeed Anwar, to provide larger brick houses for families with more than eight members. Initially, KindHearts is sponsoring 100 brick houses. This number will be expanded as more financial resources become available.

* $500,000 Worth of Medical Supplies and Medicines Provided: KindHearts has been able to provide various hospitals and mobile clinics in Bagh, Muzaffarabad, Rawalakot, Mansehra and Dhirkot with medicines and medical supplies.

KindHearts Live Appeal Telethon on PTV Prime was the first successful global Telethon that was viewed and participated in from Alaska to Australia, from North America to Africa, and from Europe to Asia. Special guests, Junaid Jumshaid, an honored Pakistani spiritual religious personality and Saeed Anwar, former Pakistani Cricket Team Captain and revered famous opening Batsman and All Rounder joined, Dr. Zulfiqar Ali Shah, a highly respected renowned Islamic Scholar who hosted the KindHearts PTV Prime Telethon to help the survivors of the tragic earthquake in Kashmir, Pakistan and South Asia.

The response from the viewers and donors to the Telethon was tremendous. Calls were overwhelming from all over the world. PTV Prime crew and the operators did a superb job of handling enormous amount of calls. This was the first time Captain Inzimamul Haq and other Pakistani Cricket team heroes such as Shahid Afridi and Yusuf Yohannah called from Pakistan to lend their support for the worthy cause. Abrarul Haq, the famous singer and Philanthropist founder of SAHARA for Life Foundation also called and appreciated KindHearts noble work to help the needy through his and other well-appreciated charities in Pakistan.

Dr. Zulfiqar Ali Shah took all incoming calls unfiltered. Al-Hamdolillah, there was all positive response and support for the noble work. It was encouraging and heart filling. However, out of thousands of calls, there were one or two negative comments by some cynical and mean spirited callers that were not appreciated by the overwhelming majority of the viewers.

Muslims to kill 'Jews, Hindus, and American worshippers of the cross'. In 2003 Al Sudais was scheduled to be

be a keynote speaker of the new ICNA Al Qaeda front - the Universal Heritage Foundation, located in Kissimee, Florida.

KindHearts Launches $3.3 Million Campaign to Build Houses for Earthquake Survivors 1,000 Permanent Homes Under Construction in Town of Kiwai.

KindHearts has launched a "Brick Houses" campaign to raise $3.3 million over the next six months to construct 1,000 brick houses in the town of Kiwai near Balakot. KindHearts has teamed up with Junaid Jamshed, the former Pakistani Pop Star and now reformed spiritual figure, and Saeed Anwar, a one-time Pakistani Cricket team captain. The project, which is currently proceeding, will accommodate between 7,000 and 9,000 earthquake survivors, and is in cooperation with the Junaid Jamshed Foundation, and under the direct supervision of Br. Junaid Jamshed and Br. Saeed Anwar.
Br. Muazzam, a local landlord who lost his 23-year-old brother in the tragedy, and who—along with his mother and sister—was seriously injured himself, has donated the land where the homes are being built. A reputable architectural firm is designing the houses in accordance with special local needs. Each house will consist of two rooms, a kitchen, bathroom and a small front yard, and cost $3,300, thereby providing a permanent residence for a family of seven to ten people.
Pakistan's northern areas are already suffering under harsh winter weather conditions with snow and below zero wind-chills. According to the Washington Post, there are more than 100,000 people who are still without shelter, and must face the cold nights without even so much as a blanket. Under these extreme conditions, if desperately needed help does not arrive in time, many of` them will die from pneumonia, flu, and other weather related conditions within weeks. Some of them may simply freeze to death!
To this end, KindHearts is moving quickly to build the necessary brick houses, which will provide protection from the elements for surviving victims of the earthquake. Truly, this is the barest minimum that we can do to help these already grieving families who are suffering from a host of diseases due to lack of food, sanitation and clean water.

Accusations of terror links still follow Toledo Muslim charity

WASHINGTON - After initially clearing 25 Islamic charities of funding terrorism, a Senate committee vowed to keep monitoring the nonprofits.

KindHearts of Toledo, Ohio, and the 24 other organizations identified by the Senate Finance Committee in 2003 remain under scrutiny by the Justice Department, The (Cleveland) Plain Dealer reported Tuesday.

The Justice Department declined to comment Tuesday to The Associated Press.

The Senate Finance Committee is done reviewing Internal Revenue Service records it requested two years ago, but that "does not mean that these groups have been cleared by the committee," chairman Charles Grassley, R-Iowa, said in a statement Tuesday.

Grassley said the committee will continue to examine the charities' operations, reversing a statement he made two weeks ago that the committee "did not find anything alarming enough that required additional follow-up beyond what law enforcement is already doing."

KindHearts says it is feeling the sting of scrutiny into its links to charitable organizations shut down after the attacks of Sept. 11, 2001. KindHearts' lawyer, Jihad Smaili of Cleveland, said testimony before the Senate Banking Committee this summer amounted to unfair "guilt by association," he told The Plain Dealer.

American Muslims were stunned after 9/11 when the U.S. government accused their three largest charities of financing terror groups and shut them all down.

For many Muslims, it was dismaying enough to learn that some of their money may have been used for nefarious purposes. But they also faced a practical problem: how to pay "zakat," the 2.5 percent annual "income tax" that all Muslims are supposed to donate to charity.

Eventually a group of Toledo Muslims filled the void by forming a new charity, KindHearts, whose mission is to support needy Palestinians in Lebanon, Gaza and the West Bank. Today, it's one of the largest Muslim charities in the country, collecting more than $4 million a year in donations

The family was not particularly devout - they skipped Friday prayers at the mosque, instead attending on Sundays, mirroring the worship patterns of their Christian neighbors - and most of the children are more or less assimilated into American society. Jihad, once an assistant prosecutor in Cuyahoga County, is now in private practice, and another brother is a plastic surgeon in Beverly Hills.

Jihad and Khaled Smaili are the sons of Lebanese immigrants who settled in Toledo decades ago.

Khaled took a different path, Jihad said. During his college years he grew a beard, began wearing robes and immersed himself deeply in Islam. At his graduation, he exchanged the traditional cap and gown for robes and a kufi, the traditional Muslim skullcap.

After college, Jihad said, Khaled worked at UPS and taught Islam in Toledo-area Muslim schools. Eventually he went to work as a fund-raiser for the Global Relief Foundation, a Muslim charity based in the Chicago area.

By 1999, Global Relief had become the second-largest Muslim charity in the country - and a rallying point for radical Islamists. That year, the Clinton administration put the group on a list of 30 organizations suspected of supporting terror groups.

In the aftermath of 9/11, FBI agents raided Global Relief's offices and seized more than $900,000 in assets. The charity, accused of financing both Hamas and al-Qaida, was eventually shut down. So were two other large Muslim charities: Benevolence International, also based in Illinois, and the Texas-based Holy Land Foundation. Each was designated by the Treasury Department as a supporter of terrorist groups.

The extent of Khaled Smaili's role in Global Relief is unclear. He has been in Lebanon for several weeks, and he did not respond to e-mailed questions.

His brother Jihad describes him as a "low-level" employee of Global Relief, noting that he was never charged with any crime.

When Jihad Smaili learned of this request, he immediately offered to provide any information the committee wanted.

"KindHearts has nothing to hide," he wrote in a letter to the Finance Committee chairmen. "Its books are open to any inquiry."

Smaili said that although he offered to testify before the committee, he never received an answer. The panel in fact never held a hearing, and a spokesman said recently that the matter had been allowed to drop.

But the Banking Committee later took up where the finance panel left off. And in hearings this summer, Steve Emerson had much to say about KindHearts.

Emerson, a former CNN reporter who has built a career as a terrorism analyst, has testified before Congress dozens of times. As early as 1998, he warned that Osama bin Laden posed a direct danger to the United States.

In July, he testified that KindHearts might have filled the void left by the closure of the Holy Land Foundation, tracing a web of connections between the Toledo-based charity and groups or individuals accused of having ties to terror and radical Islam. (See accompanying chart.)

"None of these organizational designs are simple. It's not like there's a clear line saying this is an al-Qaida front or a Hamas front," Emerson said

during a recent telephone interview.

"Militants make mileage out of earthquake relief"

In the shattered cities and toppled villages of Pakistan's earthquake zone, a new front has opened in the "war on terrorism".

As the world played aid catch-up at the weekend, pledging US$5.8 billion ($7.9 billion) in assistance, and with the Prime Minister, John Howard, due to arrive in Islamabad today, Muslim extremist groups are basking in what Pakistani commentators say is a new-found legitimacy courtesy of their quick response to the disaster.

A stream of reports since the October 8 catastrophe, which killed more than 73,000 people and left more than 3 million homeless, suggest Islamic charities linked to extremists have taken over much of the relief effort across a wide area of northern Kashmir and adjoining areas.

For days, as remote villagers waited for government help in the aftermath of the quake, fleet-footed jihadis with good knowledge of the region's mountainous terrain filled the gap, providing food and medical aid.

The epicentre of the quake, 95 kilometres north-east of Islamabad, has since the 1980s been home to training camps for Islamic militants. The town of Mansehra, a long-time hub of terrorist training that was visited by one of the men responsible for London's July 7 bombings, was badly hit by the quake.

At the forefront of the relief response has been an organisation called the Jama'at ul Dawa (JUD), considered a charitable front for the notorious Lashkar-e-Toiba terrorist group, which was banned by the Pakistani Government in 2002 but still operates. JUD was put on the Government's terrorism watch list in 2003.

Some reports say the JUD's field hospitals are better than the army's, boasting X-ray machines and pathology labs. Estimates of the number of volunteers begin in the thousands.

A prominent member of the JUD relief effort is Dr Amir Aziz Khan, arrested on suspicion of al-Qaeda links but later released.

Militants are also reportedly taking orphaned children under their wing for indoctrination in holy war in their extensive network of orphanages. Offering work to some of the 1 million people estimated by the International Labour Organisation to have lost their livelihoods due to the quake will probably be another route to recruitment.

All of which places the military ruler, Pervez Musharraf, in a tight spot. His government acknowledges JUD's good works and denies it is exploiting the disaster.

Yet visiting the region with the United Nations Secretary-General, Kofi Annan, on Friday, he felt compelled to warn the victims to be wary of help from militants. "If someone shows extremism here, you should rise up against it," he said.

Leaked reports from India's Intelligence Bureau have called a wave of terrorist violence in Indian-controlled Kashmir since the quake a virtual recruiting drive. Having displayed their compassion, Lashkar-e-Toiba's fedayeen death squads have been told to display their valour, say reports quoting confessions from arrested militants.

Pakistani governments in the past have suffered backlashes when disaster relief proved inadequate. A cyclone in the Bay of Bengal in 1970 preceded East Pakistan's becoming Bangladesh.

Since the quake, the Government has been criticised for everything from the penchant of the Prime Minister, Shaukat Aziz, for expensive suits to the decision a few days after the quake to spend $US1 billion on Swedish-made military aircraft.

The $US5 billion-plus pledged by foreign donors for quake relief is embarrassingly close to the amount Islamabad was planning to pay the US for a large fleet of F-16 fighter jets. The deal is now on hold, but critics say it should be scuppered, along with plans to build a new general headquarters for the military.

However, the efforts of troops from Australia, the US and Britain are countering extremist propaganda in the best possible way. Even arch-rival India has challenged negative perceptions among most Pakistanis by sending huge quantities of aid.

But with so many having been hurt, displaced or losing their livelihoods, and winter snows beginning to fall on the millions who live in tents, this terrible act of God seems tailor-made to serve the cause of the religious extremists.
