In a U.S. District Court, District of Massachusetts February 7, 2006 court filing, Khadr was charged with, conspiracy to murder U.S. nationals outside the United States, conspiracy to use a weapon of mass destruction, possession of a destructive device in furtherance of a crime of violence and conspiracy to possess a destructive device in furtherance of a crime of violence.

"...from in or about May, 2003, through in or about October, 2003, Khadr purchased Ak047 ammunition (for use in Russian machine guns) rocket propelled grenades, rockets and 82mm and 120 mm mortar rounds. Khadr distributed such munitions to other members of the conspiracy...for use by al-Qaeda and other fighters to kill United States and Coalition Forces military personnel..."
