Mistrial In Holy Land Prosecution, Government To Retry?

October 22, 2007 - San Francisco, CA - PipeLineNews.org - Plagued by a jury which possibly found itself ill-equipped to deal with complexity of the issues raised, and therefore unable to deliver unanimous verdicts, Judge A. Joe Fish today apparently had no choice but to declare a mistrial in the Holy Land Foundation Hamas terror funding case.

All five defendants might well stand trial again however and although the trial judge's gag order is still in effect, an unnamed source disclosed to the Dallas Morning News [source, http://www.dallasnews.com/sharedcontent/dws/dn/latestnews/stories/102207dnmetholyland.1878fd716.html] that the government has indicated that it will indeed retry the case.

The decision by the jury, failing to convict on a single count must be viewed as a tremendous setback for the Department of Justice, since the case was seen as the centerpiece in the government's effort to defund terrorism.
